Ohio data centre tariff order sets minimum demand charges and contract terms

The commission order states minimum demand charge levels, contract length and collateral requirements for data centre service.

Proceedings before the Public Utilities Commission of Ohio concerning terms of service for very large data centre loads have produced the clearest articulation yet of the regulatory bargain: a load that requires system investment may be required to commit to a minimum demand and a contract term long enough to amortise it.

The utility's interest is straightforward. Building for a load that does not arrive, or that leaves early, transfers cost to remaining customers. The load's interest is equally straightforward: minimum take obligations reduce operational flexibility and complicate site portfolio decisions.

What makes the Ohio record useful outside Ohio is the specificity of the disputed terms, which are transferable: ramp schedules, collateral, exit provisions, and the treatment of load that never energises.

For an infrastructure investor, these terms are the difference between a data centre campus that is financeable on utility service and one that requires on-site generation.

What to watch: whether approved terms are adopted substantially unchanged in other states with concentrated load growth.
